Welcome to our Terms and Conditions. These terms set out the agreement between you and Dive Aran (operated by Dive Academy Inishmore – legal name). By making a booking and payment, you are entering into a binding contract under these Terms & Conditions. This protects both you and us in the event of any queries or payment disputes.
These Terms & Conditions, together with our Privacy Policy and any order form or payment instructions, form the full agreement between Dive Aran (trading as Dive Centre, Dive School, The Diving Centre, and Dive Shop Online) (“we”, “us”, “our”) and you, the purchaser (“you”, “your”).
By booking online, by phone, by email, or in person, you confirm that you have read, understood, and agreed to these Terms & Conditions.
1.1. Payment is taken at the time of booking to confirm your place.
1.2. Your payment acts as acceptance of these Terms & Conditions and serves as your contract with us.
1.3. In the event of a payment dispute (chargeback), this agreement and proof of the services booked will be provided to your card provider or bank as evidence.
1.4. You are responsible for ensuring that you understand the services purchased and our cancellation policy before making payment.
2. Course & Training Bookings
2.1. All divers listed on a course booking will be included, and charges will be applied for all spaces booked.
2.2. Payment is required at the time of booking to confirm the place.
2.3. Candidates using Dive Aran’s equipment for any course are responsible for that equipment and will be charged for any loss or damage caused.
2.4. Candidates may not participate in diving activities without a satisfactorily completed medical statement and assumption of risk form. Failure to provide the required documents will result in loss of the booking and all fees paid.
2.5. Non-attendance of scheduled sessions will result in loss of the booking and all fees paid.
2.6. If a candidate does not meet the required performance standards during a dive or session, Dive Aran may offer an additional lesson or repeat session (subject to availability) for an extra fee. This allows the candidate the opportunity to continue the course, but progress cannot be guaranteed if requirements are not met.
2.7. Neither Dive Aran, its employees, nor contractors can be held responsible for damage to, or loss of, personal equipment before, during, or after any diving activities.
2.8. Cancellations are subject to our Cancellation Policy (see Section 4).
2.9. Minimum Course Participants.
If only one student is booked on a course date, Dive Aran will contact the student no later than 24 hours before the start of the course to discuss available options. These may include:
2.9.1 Joining the next available group course at no extra charge,
2.9.2 Upgrading to a private course for €150, or
2.9.3 Proceeding with the course if operationally possible.
Dive Aran will always do its best to accommodate the student’s travel and accommodation plans; however, all courses remain subject to operational, logistical, and safety requirements.
3. Dive Trip Bookings
3.1. All divers listed on a boat or shore dive booking will be included in the booking, and charges will be applied for all spaces reserved.
3.2. Payment is required at the time of booking to confirm the place.
3.3. Once the dive group departs the Dive Centre, the dive will be considered to be taking place.
3.4. Dive Aran reserves the right to change the dive site, vessel, or port of departure without notice if required due to weather conditions, safety considerations, or any other reason.
3.5. Dive Aran reserves the right to refuse participation if, in our opinion, a diver is not suitable for the chosen dive. In this case, the diver remains liable for the full charge of the dive.
3.6. All divers must follow Dive Aran’s Diving Practices at all times. A copy is available on request. Our decision on any diving matter is final.
3.7. Divers using Dive Aran’s equipment for any scuba activities are responsible for that equipment and will be charged for any loss or damage, however caused.
3.8. Cancellations are subject to our Cancellation Policy (see Section 4).
3.9 Boat Dive Minimum Numbers
Boat dives at Dive Aran require a minimum of three (3) divers to operate.
3.9.1 If only two (2) divers are booked, the boat dive may still run with a €10 low-number supplement per diver, or divers can choose to switch to a Shore Fun Dive instead.
3.9.2 If only one (1) diver is booked, Dive Aran will offer alternative options, including:
a) joining another scheduled Boat Fun Dive at no extra cost,
b) completing a Shore Fun Dive, or
c) upgrading to a private boat dive (additional charges apply).
3.9.3 Wormhole Special Boat Dives
Wormhole dives require a minimum of four (4) divers to run at the standard price.
If only three (3) divers are booked, the trip may still run with a €15 low-number supplement per diver.
If fewer than three (3) divers are booked, Dive Aran will offer alternative options, including:
a) joining a Boat Fun Dive at the standard rate,
b) completing a Shore Fun Dive, or
c) transferring to another scheduled Wormhole dive where numbers permit.
All boat activities are subject to suitable sea conditions, operational capacity, and the skipper’s discretion for safety.
4. Cancellation Policy
4.1. Cancellations by You
You may cancel your booking at any time by SMS to +353 (0) 85 725 726 0 or by emailing info@divearan.com.
Cancellations take effect from the day notice is received and will be confirmed in writing by us.
Cancellation charges:
30 days or more before the event: No cancellation fee.
29 days or less before the event: 100% cancellation fee.
4.2. We cannot accept responsibility for cancellations due to external travel disruptions such as ferry cancellations, flight cancellations, missed connections, or other transport issues. In such cases, no refund will be given, and the full cancellation fee will apply.
4.3. Customers wishing to secure protection against travel disruptions are advised to arrange suitable travel insurance.
4.4. Cancellations or Changes by Us
We may occasionally need to make minor changes (e.g., classroom, dive site, or port changes) and reserve the right to do so.
If the minimum number of participants is not met, we may cancel. In such cases, we will offer to reschedule your booking or transfer your payment to account credit.
We are not liable for compensation if cancellation or rescheduling occurs due to circumstances beyond our control, including but not limited to: war, terrorism, civil unrest, industrial disputes, natural disasters, epidemics, transport issues, or severe weather conditions.
If external travel disruptions (such as ferry or flight cancellations) prevent you from attending, this will be treated as a customer cancellation under Section 4.2.
5. Kayaking
5.1. All participants must be at least 8 years of age and able to paddle without assistance. Participants under 18 must be accompanied by a guardian aged 18 or older. Where a Dive Aran guide is present on the water, participants aged 16 and above may share a kayak without an adult guardian.
5.2. Children must always be supervised by a responsible adult (18+) while on the water.
5.3. All participants hire equipment at their own risk and must sign a waiver before departure.
5.4. Kayaks must not exceed the authorised capacity set by Dive Aran:
Single kayak: 1 person
Double kayak: 2 people
5.5. Participants are fully responsible for the hire equipment, passengers, and third parties while in control of the kayak and related equipment. Any loss or damage must be reimbursed to Dive Aran.
5.6. Equipment must be returned to the hire point at the agreed end time.
5.7. Participants acknowledge the inherent risks of kayaking and accept that hire is entirely at their own risk. Dive Aran’s insurance does not cover negligence or irresponsible behaviour.
5.8. Dive Aran is not responsible for personal injuries, or for equipment loss or damage, sustained while embarking or disembarking equipment.
5.9. Individuals with back, neck, shoulder, or heart conditions, pregnant participants, or those with injuries/conditions that may affect safety participate at their own risk.
5.10. Outdoor marine conditions vary, and participants should expect to get wet.
5.11. Smoking and alcohol are not permitted on equipment at any time.
5.12. Dive Aran reserves the right to refuse service to anyone believed to be under the influence of alcohol or drugs. No refund will be provided.
5.13. Dive Aran reserves the right to refuse participation to any individual for safety or other reasons.
5.14. Cancellations are subject to our Cancellation Policy (see Section 4).
6. Gift Vouchers
6.1. There are two types of Gift Vouchers:
Specific Gift Voucher: Covers a specific activity and number of participants.
Generic Gift Voucher: A monetary value voucher that can be used for any booking until fully redeemed.
6.2. A Specific Gift Voucher may only be redeemed for the activity stated on the voucher and must be used in full in one transaction. Vouchers cannot be topped up once purchased.
6.3. A Generic Gift Voucher may be used multiple times for any booking until the full value is redeemed.
6.4. All Gift Vouchers are valid for 5 years from the date of purchase.
6.5. Gift Vouchers may be purchased in-store at Dive Aran or online.
6.6. Online orders containing eGift Vouchers can be downloaded and printed once the purchase is completed.
6.7. No refunds will be issued once a Gift Voucher has been purchased.
6.8. Gift Vouchers are redeemable at Dive Aran in-store or online only and cannot be exchanged for cash.
6.9. To report a lost or stolen Gift Voucher, contact us by SMS at +353 (0) 85 725 726 0 or email info@divearan,com.
6.10. The original sales receipt is required to replace any remaining balance on a lost or stolen Gift Voucher.
6.11. Bulk purchases of Gift Vouchers are available for corporate or personal use. Please email or call us for assistance.
6.12. Dive Aran makes no warranties, express or implied, regarding Gift Vouchers, including but not limited to warranties of merchantability or fitness for a particular purpose.
6.13. Purchase or use of a Gift Voucher constitutes acceptance of these Gift Voucher Terms & Conditions. These terms are subject to change without notice and are also governed by Dive Aran’s Privacy Policy and Terms of Use.
7. General Conditions
7.1. Dive Aran may charge an administration fee for customer-requested amendments to scheduled sessions.
7.2. All courses must commence within 8 months of booking unless agreed otherwise. Bookings not commenced within 8 months will result in the loss of fees paid.
7.3. Candidates agree to abide by the rules and decisions of Dive Aran staff and subcontractors in all training matters.
7.4. No refunds will be made once a course or dive trip has started.
8. Liability & Media
8.1. Dive Aran accepts no liability for loss of, or damage to, personal property (including diving equipment). Any equipment left on boats, in the Dive Centre, overnight, or during transport is entirely at the owner’s risk.
8.2. Participants may be filmed or photographed during activities. Dive Aran reserves the right to use such films or photos for any purpose without notification, compensation, or payment.
8.3. Dive Aran reserves the right to amend these Terms & Conditions at any time without notice.
